EB-2 and National Interest Waiver

EB-2 can be employer-sponsored. In eligible cases, a National Interest Waiver may allow the applicant to ask that the usual job-offer and labor-certification requirements be waived. NIW cases depend heavily on the proposed endeavor and supporting evidence.

Employer-sponsored EB-2

Requires an employer to file a petition and, in most cases, complete PERM labor certification first. The position must require an advanced degree or the equivalent, or the applicant must have exceptional ability.

National Interest Waiver

The NIW allows some EB-2 applicants to self-petition by waiving the job offer and labor certification if they can show their work is in the national interest of the United States based on the three-part Dhiab standard.

A clearly defined proposed endeavor, evidence of substantial merit and national importance, the ability to advance that endeavor, and a benefit to the United States that outweighs the national interest in normal requirements.
